Time has come again for us all to jump on the change wagon, it would seem! Yesterday, Statutory Instrument No 1181 of 2010 passed through Parliament to give us the final changes to the Criminal Defence Service (Funding) (Amendment No. 2) Order 2010.
The changes, in a nutshell, are as follows:-
1) Fees will be reduced by 4.5% each year for the next three years;
2) Cases up to and including 60 days will be funded under the AGFS scheme, meaning that VHCC will not apply until a case extends beyond 60 days. In a nutshell, this means that you will be claiming 4.5% less fees (each year for the next three years) and that VHCC funding will only be available for trials greater than 60 days in length.
The changes are effective in relation to any cases funded under any order granted on or after 27th April 2010.
Further changes will be effective on orders granted on or after 1st April 2011 and 1st April 2012 (each of which are further reductions that, when added to this year's reduction, will total 13.5% by 2012).
